Former Days of Our Lives star Arianne Zucker (ex-Nicole) is making significant progress in her lawsuit against the soap.

A Los Angeles County judge decisively ruled on Aug. 8 that Zucker is permitted to proceed with the part of her complaint that is being contested by former executive producer Albert Alarr, who is one of the defendants.

In February, Zucker filed a lawsuit against Corday Productions Inc., DAYS’ executive producer Ken Corday, and Alarr, alleging sexual harassment. Zucker is pursuing claims of harassment, discrimination, retaliation, negligent hiring and supervision, and wrongful termination.

Her lawsuit alleges sexual harassment and intentional infliction of emotional distress, but it’s the judicial order under a section of California’s business code that Alaar’s lawyers argued wasn’t necessary since he’s not currently employed.

Rolling Stone reports that the judge disagreed. “ ‘Plaintiff has alleged a long-standing course of conduct by Mr. Alarr. An inference arises from the facts alleged that the behavior would be likely to recur,’ Judge Kristin S. Escalante wrote in her ruling issued hours after the morning hearing.”

The judge asserted that even if Alaar is no longer working, if Zucker can substantiate her allegations, an injunction could be considered appropriate. Zucker’s attorney told Rolling Stone, “Ms. Zucker wants to ensure that no other woman can be harmed at the hands of Alarr again, and I will fight to make that happen.”

The case is set to be heard in court coming October.
